📘 General Terms and Conditions of Sale

📄 1. Purpose and Scope

These general terms and conditions define the rights and obligations of MyFarm and the customer in the context of the sale of:

  • MyFarm products (aquaponic kits and extensions),
  • Euro-Serre products,
  • ACD products.

Any order placed on myfarm.eu implies full acceptance of these terms.


🌿 2. Conditions of Sale

2.1. MyFarm Products

📦 2.1.1. Items to be Acquired by the Customer

The customer acknowledges that certain necessary items are not included in the kit, such as:

  • clay balls,
  • fish and food,
  • seeds,
  • power supply (socket to be provided in the greenhouse).

🏡 2.1.2. Compatibility with Third-Party Greenhouses

If the greenhouse is not purchased from MyFarm.eu, it is the customer's responsibility to contact MyFarm to verify its compatibility with the kit.

🛠️ 2.1.3. Installation

The MyFarm kit and its extensions are installed by the customer.

⏳ 2.1.4. Validity of Offers

The price offer sent by email is valid for 7 days from the date of sending.

After this period, the prices displayed on the site automatically apply.

🚚 3. Delivery

📬 3.1. Tracking and deadlines

Notifications are sent at each stage of the delivery.

The deadlines are indicative and cannot lead to cancellation or compensation in case of delay.

📍 3.2. Mandatory presence

The customer agrees to be present on the agreed delivery date.

⚠️ 3.3. Transfer of risks

Risks are transferred to the customer at the time of delivery.

📦 3.4. Receipt and transport-related damages

The customer must inspect the products at the time of delivery.

Any visible damage or anomaly must be reported to the carrier at the time of delivery and notified to MyFarm within 48 hours, with supporting photos.

Beyond this period, MyFarm cannot guarantee that the damage will be covered by the carrier.


🔄 4. Return policy

4.1. MyFarm products

📜 4.1.1. Legal right of withdrawal

In accordance with European legislation, the customer has a legal right of withdrawal of 14 days from the receipt of MyFarm products. However, MyFarm offers a more advantageous return policy, detailed below.

⏱️ 4.1.2. 60 days to change your mind

The customer can return the MyFarm kit and/or its extensions within 60 days of delivery, provided there is no major alteration.

💰 4.1.3. Full refund

Refund upon receipt and verification of the equipment.

💚 4.1.4. Free return

MyFarm returns are completely free.

📦 4.1.5. Packaging conditions

The customer must carefully repackage the kit and follow the instructions provided by MyFarm.

MyFarm may adjust the refund in case of product alteration.

4.2. Euro-Serre and ACD products

📜 4.2.1. Legal right of withdrawal

The greenhouses we offer are manufactured or configured specifically according to the customer's specifications. In this case, and in accordance with the law, the right of withdrawal does not apply. No return or refund can be demanded for customized greenhouses.


💳 5. Billing and payments

📌 5.1. Accepted payment methods

MyFarm accepts the following payment methods:

  • Bank transfer (free)
  • PayPal (3% surcharge corresponding to PayPal fees)
  • Installment payment in 6 or 12 monthly payments via SEPA direct debit

🧾 5.2. Standard payment terms

Unless a specific agreement for installment payment is made:

  • 40% upon order confirmation,
  • 60% before shipping.

The order is only considered validated after receipt of the first payment.

📆 5.3. Payment in 6 or 12 installments via secure SEPA

Process:

  • Signing a mandatory SEPA mandate.
  • Mandatory deposit of 40% upon order.
  • Fixed administrative fees of €80, charged at the first payment, regardless of the chosen plan.
  • Payment in installments over 6 or 12 months.
  • Direct debits are made automatically according to the communicated schedule.

Obligations and incidents:

  • Monthly payments must be honored for the entire duration of the payment plan, including after the delivery of the product.
  • Cancellation of the SEPA mandate or uncommunicated changes to the bank account do not release the customer from the full payment of the amounts due.
  • In case of a rejected direct debit, any bank fees are the responsibility of the customer.

In case of repeated payment default, MyFarm reserves the right to:

  • suspend deliveries and services,
  • demand immediate payment of the remaining balance due,
  • transfer the file to the Venturis collection service.

⚠️ 5.4. Late payment

In case of late payment, a first reminder will be sent free of charge.

If the customer does not pay within the payment period specified in the first reminder (15 days), the customer will owe late payment interest, in accordance with the law of August 2, 2002, relating to the fight against late payment in commercial transactions, and a flat-rate compensation calculated as follows:

  • €20 if the amount due is less than or equal to €150;
  • €30 plus 10% of the amount due on the portion between €150.01 and €500, if the amount due is between €150.01 and €500.
  • 65 euros increased by 5% of the amount due on the portion exceeding 500 euros, with a maximum of 2,000 euros, if the balance due is greater than 500 euros.

The management of collections is handled by Venturis.

💶 5.5. Pricing Errors

In case of a manifest pricing error (incorrect display, technical bug, or abnormally low value), MyFarm reserves the right to cancel the order.

The customer will be informed immediately and fully refunded if applicable.


🛡️ 6. Responsibilities

MyFarm cannot be held responsible for:

  • the health of plants,
  • the health of fish,
  • the consumption of plants or fish from the system,
  • damages resulting from improper installation or use.


🌩️ 7. Force Majeure

MyFarm cannot be held responsible for any delay, modification, or inability to perform resulting from a force majeure event, such as: natural disasters, bad weather, strikes, computer failures, stock shortages from a supplier, or any other event beyond its control.


🔐 8. Retention of Title

The products remain the property of MyFarm until full payment is made.
